The Winner's Circle Daily Prize — Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN — AND NO PURCHASE IS POSSIBLE. A PURCHASE OR PAYMENT OF ANY KIND CANNOT ENTER YOU IN THE CONTEST AND WILL NOT IMPROVE ANY CONTEST OUTCOME. VOID WHERE PROHIBITED.

1. The Contest

1.1. "The Winner's Circle Daily Prize" (the "Contest") is a free-entry promotional skill contest sponsored, operated, and funded solely by Winner's Circle Picks LLC, 137 E 38th St., New York, NY 10016 (the "Sponsor"), offered within the Winner's Circle mobile application (the "Service"). Winners are determined by skill in sports analysis and prediction — sustained pick performance against real published odds — and not by chance, drawing, or random selection.

1.2. A series of discrete monthly promotions. The Contest is conducted as separate, discrete promotions, one per calendar month (each a "Monthly Promotion", e.g., "The Winner's Circle Daily Prize — [Month Year]"). Each Monthly Promotion begins at 12:00:00 a.m. US Eastern Time ("ET") on the first day of its calendar month and ends at 11:59:59 p.m. ET on the last day of that month, and consists of consecutive "Daily Prize Periods" — one per ET calendar day. Each Monthly Promotion has its own aggregate prize maximum (Section 6.4). Sponsor's announcement of a Monthly Promotion consists of publication of these Rules in the Service and on this page.

1.3. No wagering. The Contest involves no real-money wagering of any kind. Picks are made exclusively with free virtual units that have no cash value, cannot be purchased, and can never be converted into money (Section 3). No entrant ever stakes, risks, or pools money or anything of monetary value on the outcome of any sporting event.

1.4. Apple Inc. is not a sponsor of, or involved in, this contest in any manner. The Contest is also not sponsored, endorsed, or administered by, or associated with, any sports league, team, athlete, sportsbook, odds provider, Google LLC, or Stripe, Inc.

2. Eligibility

2.1. The Contest is open only to natural persons who, at the time of entry: (a) are at least 18 years old (or the age of majority in their jurisdiction, if higher); (b) are legal residents of, and physically located in, the United States; and (c) hold exactly one Winner's Circle account in their own name, in good standing under the Terms of Service.

2.2. Excluded states. Residents of Washington, Arizona, Hawaii, Louisiana, Montana, and Nevada are not eligible to win or receive prizes. Such residents may otherwise use the Service. Sponsor may update the excluded list prospectively for future Monthly Promotions.

2.3. Employees, officers, directors, members, and contractors of Sponsor, and members of their immediate families (spouse, parents, children, siblings, and their spouses) or households, are not eligible.

2.4. The Contest is void where prohibited or restricted by law.

2.5. Verification. Potential winners' eligibility (including age and state of residence) is subject to verification, including identity verification conducted by Stripe before any prize withdrawal (Section 6.7). Sponsor's eligibility determinations are final. A prize attributable to an entrant found ineligible is forfeited and returned to the prize pool as rollover (Section 6.3).

3. How to enter — free

3.1. Download the Winner's Circle app (free), create an account (free; date-of-birth attestation required), and receive 5.0 free virtual units at the start of each ET day. Unused units do not carry over.

3.2. Entry method: placing picks. You enter the Contest by placing virtual-unit picks on real sporting events at the published reference odds shown in the Service, at least one hour before the event's scheduled start time. Placing picks with free virtual units is the sole method of entry; no alternate method of entry exists or is needed, because entry is already completely free. Entries per day are naturally limited by the free daily unit allotment.

3.3. Units are not money. Virtual units have no cash value; they cannot be purchased, sold, transferred, or exchanged; and they can never be converted into money or anything of monetary value. Losing units costs you nothing and never impairs your ability to keep entering: units are re-granted every day regardless of results.

3.4. No purchase can touch the Contest. Nothing Sponsor sells — including Day Passes and Week Passes, which purchase viewing access to other users' picks — enters the purchaser in the Contest, funds any prize, or affects any Contest outcome in any way. There is no paid path into the Contest.

4. Qualifying for the Winner's Circle — published selection criteria

4.1. Each ET day at midnight, Sponsor's servers recompute the day's Winner's Circle roster. You qualify for a given day when, over the trailing 7 ET calendar days, your settled counted picks (Section 4.2) show: (a) qualification profit of at least +7.0 units, and (b) at least 7 settled counted picks ("7-7-7").

4.2. How qualification profit is computed (these mechanics are part of these Rules and are applied identically to every entrant):

  1. Stake scaling. Each pick's profit or loss counts as if staked at most 2.0 units: the pick's actual profit or loss is multiplied by (the lesser of its stake and 2.0) ÷ its stake.
  2. Per-pick cap. After stake scaling, a single pick's positive contribution is capped at +4.0 units.
  3. Offsetting picks do not count. Picks by the same entrant that directly oppose each other on the same event and market — for example, both teams to win the same game; both the Over and the Under at the same total; or both sides of a point spread at negating points — are excluded entirely from qualification math: both picks contribute no profit or loss and do not count toward the 7-pick minimum. A parlay containing any leg that directly opposes another of the entrant's picks is excluded in full. Opposite-side picks at materially different lines (a "middle") are not offsetting and do count.
  4. Pushed and voided picks are excluded from qualification math (stakes refunded in units).

4.3. Winner's Circle membership is an eligibility status recomputed once daily; it rotates with performance and confers no guaranteed prize, earnings, or continuation. The trailing 7-day window is a rolling eligibility criterion; picks placed in a prior calendar month may count toward eligibility without constituting entries in a prior Monthly Promotion.

5. Winner determination — each Daily Prize Period

5.1. Eligible entries for a Daily Prize Period are picks placed by that day's Winner's Circle members on events commencing that ET day.

5.2. A pick wins when it settles as a win under the Service's published grading rules, applied server-side from official final results. Pushed and voided picks (including events not completed within 72 hours of their scheduled start) neither win nor lose and receive nothing.

5.3. Prize allocation formula. After all of the day's eligible picks settle, the day's prize pool is divided among the day's winning eligible picks in proportion to each winning pick's capped prize weight: the lesser of the pick's net units won (its profit, or "to-win" amount) and 4.0. Offsetting pick pairs (as defined in Section 4.2(c), applied to the day's picks) are excluded from prize allocation. Each winning pick's share equals (its capped prize weight ÷ the sum of all winning eligible picks' capped prize weights) × the day's prize pool, computed in whole US cents with largest-remainder rounding so that payments sum exactly to the pool. Losing, pushed, and voided picks receive nothing.

5.4. Skill determines winners. There is no drawing and no random selection. The number of winners and the size of each share depend entirely on entrant performance; because winners are determined by skill, no statement of "odds of winning" applies. It is possible for a Daily Prize Period to have many winners, one winner, or none.

5.5. If a Daily Prize Period ends with no winning eligible pick (or with no Winner's Circle members), no prize is awarded for that day and the pool rolls over (Section 6.3).

6. Prizes

6.1. Daily prize pool: $100.00 (USD) per Daily Prize Period, funded solely by Sponsor from Sponsor's own funds. Customer payments to Sponsor (including pass purchases) never fund, and are never pooled into, any prize. No fee, rake, or deduction of any kind is taken from any prize pool.

6.2. The prize pool figure displayed in the Service is the actual amount payable for that Daily Prize Period (the daily amount plus any rollover, subject to Section 6.4).

6.3. Rollover. If no prize is awarded for a Daily Prize Period (Section 5.5) or a prize is forfeited (Section 2.5), the unawarded amount carries forward into the next Daily Prize Period's pool, including across a calendar-month boundary. Rollover amounts count toward the aggregate prize maximum of the Monthly Promotion in which they are actually awarded (the receiving month), regardless of when they accrued.

6.4. Monthly aggregate prize maximum: $4,999.00. Total prizes awarded in any single Monthly Promotion will not exceed $4,999.00 (USD), counting every dollar actually awarded during that month, including awarded rollover. If awarding a Daily Prize Period's full pool would cause the Monthly Promotion's aggregate awarded prizes to exceed $4,999.00, only the portion that fits within the maximum is awarded for that day (allocated under Section 5.3), and the excess remains in the pool as rollover for the next Daily Prize Period (and counts toward the Monthly Promotion in which it is eventually awarded). Because monthly funded amounts total at most $3,100.00 (31 days × $100.00), this maximum can bind only when substantial rollover is carried in.

6.5. Total approximate retail value per Monthly Promotion: up to $4,999.00 ($2,800.00–$3,100.00 in newly funded daily prizes depending on the month's length, plus any awarded rollover, never exceeding the Section 6.4 maximum).

6.6. Prize crediting. Prizes are credited in US dollars to the winner's in-app wallet, generally within three (3) days after the Daily Prize Period's final eligible pick settles. Sponsor's server ledger is authoritative.

6.7. Withdrawal; W-9 required. Wallet balances are withdrawn via Stripe Connect (minimum withdrawal $10.00; currently full-balance only). Before any withdrawal, the winner must complete Stripe's identity verification (KYC) and provide complete and accurate taxpayer identification information (IRS Form W-9 information); completion of both is a precondition of any withdrawal. Withdrawal typically arrives within several business days, subject to Stripe and the winner's bank.

6.8. Taxes. Prizes are taxable income and are the winner's sole responsibility. Where required, Sponsor (directly or through Stripe) will report prizes on IRS Form 1099-MISC (currently required when a winner's prizes total more than $2,000 in a calendar year) and comply with corresponding state requirements. Winners agree to provide any additional tax documentation reasonably requested.

6.9. Prizes are non-transferable and may not be assigned; no substitution by the winner. Prizes are awarded in USD only.

7. Integrity and disqualification

7.1. One account per person. Entrants may not: use bots, scripts, or automation; create, control, or coordinate multiple accounts (including placing opposing picks on the same event across accounts); collude with other entrants; or otherwise manipulate qualification, settlement, or prize allocation.

7.2. Sponsor may disqualify any entrant, void qualification, and withhold or recover any prize attributable to conduct prohibited by these Rules or the Terms of Service, and may pursue any other available remedy. Attempted fraud or tampering with Contest operation may be a violation of criminal and civil law.

8. Publicity

Except where prohibited by law, participation constitutes the entrant's consent for Sponsor to display the entrant's username, picks, performance statistics, and prize amounts within the Service and in Sponsor's promotional materials, without additional compensation. Usernames are pseudonymous; Sponsor will not publish a winner's legal name without separate consent except as required by law (including Section 11).

9. General conditions

9.1. Sponsor's computation of pick results, qualification, winners, and prize amounts on its servers is final and binding on all entrants, subject to correction of demonstrated data errors from the official results provider.

9.2. Sponsor reserves the right to cancel, suspend, or modify a Monthly Promotion or the Contest series if fraud, technical failure, or any cause beyond Sponsor's reasonable control impairs its integrity or proper operation, or as required by law. Prizes already awarded for completed Daily Prize Periods are unaffected. Modifications (including to the daily prize amount, formula, excluded-state list, or the existence of cash prizes) apply prospectively only and will be reflected in updated Rules before the Monthly Promotion to which they apply.

9.3. By entering, entrants agree to release and hold harmless Sponsor and its officers, members, employees, and agents, and Apple Inc., from any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, except where such a release is prohibited by law and excluding claims of fraud or willful misconduct.

9.4. These Rules incorporate the Terms of Service (including its limitations of liability) and Privacy Policy. If these Rules conflict with a summary of the Contest anywhere else (including Terms of Service Section 6, the Service, or this website), these Rules control.

10. Disputes; governing law

Any dispute arising out of or relating to the Contest is subject to the dispute-resolution provisions (binding individual arbitration and class-action waiver, with a small-claims carve-out and opt-out right) of the Terms of Service, Section 13. These Rules are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.

11. Winners list

For a list of winning usernames and prize amounts for any completed Monthly Promotion, email support@winners-circle.co with the subject "Winners List — [Month Year]" within 60 days after that Monthly Promotion ends.
